Welcome to FollowLeadly CRM. Please read these Terms of Service ("Terms") carefully before using our website, platform, services, AI systems, and applications (collectively, the "Service") operated by FollowLeadly CRM ("us", "we", or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, sales representatives, administrators, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Acceptance of Terms
By creating an account, authenticating via OTP (One-Time Password), or using our Service in any manner, you represent that you are at least 18 years of age and possess the legal capacity to enter into binding agreements.
If you are entering into this agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity and its affiliates to these Terms, in which case the terms "User", "you", or "your" shall refer to such entity.
2. Description of Service
FollowLeadly CRM provides a cloud-based sales pipeline, lead management, and follow-up automation platform. Core offerings include, but are not limited to:
- Lead Management: Organization of contact records, requirement trackers, and status pipelines.
- AI-Driven Followups: Localized and API-based generation of text follow-ups, emails, SMS drafts, and summaries.
- WhatsApp CRM Integration: Direct messaging and automated interactions through the Meta WhatsApp Business API.
- White-Labeled Quotations & Invoices: Brand customization modules enabling custom logos, contact info, and status indicators.
- Goal and Revenue Tracking: Calculation of closed deals, expected win probabilities, monthly targets, and ROI.
We reserve the right to modify, suspend, or discontinue any feature, tool, or aspect of the Service at any time, with or without notice, to facilitate system performance, security updates, or feature additions.
3. Accounts, Verification & Security
To prevent unauthorized access and verify your identity, FollowLeadly CRM utilizes a passwordless mobile OTP authentication system. You agree to:
- Provide a valid, active mobile phone number that you legally own and have the authority to receive messages on.
- Maintain the confidentiality of verification codes received. You must not disclose OTP credentials to any third party.
- Immediately notify us of any suspected security breach or unauthorized use of your phone number associated with the Service.
- Acknowledge and agree to our automated rate-limiting, IP tracking, and audit logging measures designed to protect the system from brute-force attacks and abuse.
You are entirely responsible for all activities, data entries, and billing charges incurred under your verified account. We are not liable for any losses caused by unauthorized use of your account.
4. Fees, Billing & Subscriptions
Certain parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic cycle (monthly or annually) depending on the plan selected:
- Free Plan: Billed at ₹0/month, restricted to 1 user and up to 50 active leads.
- Pro Plan: Billed at ₹999/month, restricted to 1 user and up to 2500 active leads.
- Elite Plan: Billed at ₹2,499/month, restricted to 1 user, and up to 10000 active leads.
- Team Starter Plan: Billed at ₹2,999/month, restricted to 5 users and up to 20000 active leads.
- Team Growth Plan: Billed at ₹7,999/month, restricted to 20 users and up to 100000 active leads.
- Enterprise Plan: Custom pricing, custom users, dedicated account management, and custom feature implementations.
Refund Policy & Free Trial:
We offer a 14-day free trial on our plans without requiring a credit card. Because you can fully test the Service before purchasing, all subscription fees are non-refundable. We do not provide refunds or credits for partially used billing periods, downgraded accounts, or unused time. You may cancel your subscription at any time to prevent future recurring charges.
Subscriptions automatically renew under the same conditions unless cancelled. A valid payment method is required. In the event of a billing failure, access to premium features may be temporarily suspended until payment is successfully processed.
5. User Conduct & Content Guidelines
Our Service allows you to store, import, export, and manage leads, client information, notes, and quotation data (collectively, "Content"). You retain all ownership rights to your Content.
However, you agree not to use the Service to:
- Upload or transmit any spam, unsolicited messages, or unauthorized marketing materials.
- Store or process personal data of individuals who have not consented to such tracking (under applicable privacy regulations).
- Use automated scripts or scrapers to extract data from the Service without express permission.
- Inject malicious code, viruses, or exploit vulnerabilities in our hosting infrastructure.
6. Data Protection & Processing
Your privacy is crucial to us. The processing of any personal data, lead contact numbers, emails, and transaction histories is governed strictly by our Privacy Policy.
FollowLeadly CRM acts as a **Data Processor** concerning your lead information, and you act as the **Data Controller**. You are responsible for ensuring that your collection and usage of lead data complies with local jurisdictions (such as GDPR, CCPA, or DPDP Act).
7. Intellectual Property Rights
The Service and its original content (excluding Content provided by users), features, codebase, design styles, SVGs, brand assets, and AI logic are and will remain the exclusive property of FollowLeadly CRM and its licensors.
Our trademarks, trade dress, and logos may not be used in connection with any product or service without our prior written consent.
8. Limitation of Liability
In no event shall FollowLeadly CRM, nor its directors, employees, partners, agents, or suppliers, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Service.
- Any conduct or content of any third party on the Service.
- Any content obtained from the Service.
- Unauthorized access, use, or alteration of your transmissions or content.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or request account deletion by contacting support.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
